TERMS AND CONDITIONS FOR BOOKINGS AND TOURS
PLEASE READ CAREFULLY

FOR TOUR ARRANGEMENTS: TURKEY AT ITS BEST is a Service Mark of Newport International Travel, provider of upscale private tours to Turkey since 1986. Please see “About Our Tours” pages and call us for some of our popular itineraries. We shall be happy to design other, customized, itineraries to suit your specific requirements.

RESERVATIONS AND PAYMENTS: Reservations should be made as early as possible to confirm the desired tour dates. We shall do our best to accommodate each request. A deposit of $350 per person is required at the time of the booking to provide a confirmed reservation; the balance is due 60 days prior to the start date of the tour. Within the final payment period reservations must accompany full payment. A handling fee of $50 per transaction will be charged for any alteration or revision made to the booking, if such revision is permissible. Types of payments, to be made in U.S. Dollars, can be one of the following: By credit card, where a signed form with additional information shall be required; By wire transfer; or, By a Cashier’s Check issued from a bank in the USA.

CANCELLATIONS AND REFUNDS: Newport International Travel, your tour operator, reserves the right to cancel any tour at any time without penalty to the tour operator, for any reason. If Newport International Travel cancels a tour, the company has no responsibility beyond the refund of all monies paid to the company by the tour participant. If participants cancel, all cancellations must be delivered in writing to, and received by, Newport International Travel. If cancellation notice is received by Newport International Travel no closer than 90 (ninety) days before the tour start date, the deposit, less $50 non-refundable handling fee per person, will be refunded. Within 90 days, but more than 30 (thirty) days before the tour start date, a $150 per person cancellation fee plus all non-recoverable payments made to hotels, transportation companies, etc. will be charged. No refunds are possible for cancellations received 30 days or less prior to the tour start date, or for unused portions of the tour. Once airline tickets are issued, additional penalties from air carriers and tour operator apply upon changes as well as upon cancellations of air tickets.

INSURANCE: Newport International Travel strongly advises purchase of travel insurance covering medical assistance, emergency service, baggage loss or damage, and default of providers, as well as trip cancellation insurance; such insurance is also available through Newport International Travel upon request.

TRAVEL DOCUMENTS AND HEALTH REQUIREMENTS: Citizens of the United States of America must be in possession of a valid passport which should not expire until 6 months after the completion of the tour. Each tour participant is responsible to obtain the required travel documents and visas, and to seek information on health and safety advisories, legal requirements, and other official notices, from government sources.

TURKISH VISAS may be obtained by U.S. citizens after paying a visa fee in cash, in U.S. Dollars, upon arrival at the airport (or other port of entry) in Turkey. Newport International Travel shall be pleased to advise you, at the time of the booking, about the most recent announcement concerning the applicable Visa Fee (which has been changed from time to time). Citizens of other countries should inquire about Turkish Visa requirements and Fees from the nearest Turkish Consulate.

TOURS INCLUDE: Hotel accommodations as shown on each itinerary, in the category selected, meals as indicated (B,L,D or Breakfast, Lunch, and Dinner) on the itineraries and in tour documents, all indicated entertainment (if any), sightseeing in private air-conditioned tour vehicle with a private English-speaking Professional Tour Guide, unless another language has been specified by the tour operator. All museum entrance fees, service charges and hotel taxes are also included in the tour price, unless indicated otherwise. Per person prices are based on two persons sharing a twin-bedded "run-of-the-house" room with private bath or shower, unless indicated otherwise. Where transfers are included in the itinerary, there may be an additional charge for arrivals and departures that do not coincide with the arrival/departure meeting times indicated on the itinerary; there shall be no refund or offset owed for a transfer missed by the traveler.

NOT INCLUDED IN TOUR PRICE: Airline tickets (unless specified as “included”), Passport and Visa fees, airport departure and other taxes and fees or charges, excess baggage, customs duties and fees, meals outside of those specified in the itineraries, tips, beverages (unless noted otherwise on the itinerary), except for bottled drinking water supplied at the tour vehicle, emergency expenditures, and any items or features not specifically included in the itinerary are not included in the tour price. Items of a personal nature, such as a-la-carte orders, room service, communication charges, laundry, extra hotel charges such as for late checkout, the customary gratuities to the guide, driver, hotel and cruise personnel, camera fees, and items other than those specifically indicated, are not included in the tour price.

AIR TRANSPORTATION may be provided separately or as part of a "Land & Air Package." All airfares are subject to change until ticketed, and are governed by the rules of air carrier(s). The airlines concerned are not to be held responsible for any act, omission or event during the time the passengers are not on board their aircraft. Service Fees may be applicable for issuing of airline tickets, and for any subsequent changes made to these tickets, along with any airline penalties.

CHANGES IN THE ITINERARY: The tour operator will make its best efforts to operate the tour in accordance with the itinerary, and to include as many features as described. Situations may arise, however, that necessitate revisions in the itinerary. Newport International Travel reserves the right to alter the itinerary if it becomes necessary (in its own opinion) to do so.

RESPONSIBILITY: The responsibility of the tour operator, Newport International Projects Company, Incorporated, dba Newport International Travel, is limited. Newport International Travel, its affiliates, and agents act only as intermediaries and agents for suppliers in all functions pertaining to hotel reservations, services, sightseeing, travel and transportation of whatever nature, which are not directly supplied by Newport International Travel. All reservations, rates, schedules, accommodations and services are subject to change. All certificates and other travel documents for travel services issued by Newport International Travel are subject to the terms and conditions specified by the suppliers, and to the laws of the countries in which the services are supplied. By acceptance of participation in a tour, the tour participant agrees that neither Newport International Travel nor its officers, employees or representatives shall become liable for loss, damage, accident, personal injury, death, or inconvenience caused by or resulting from the malfunction of transportation equipment, hazards of sea, air or land, disease, local laws, strikes, any occurrence beyond the control of the tour operator, cancellation due to war or terrorist or criminal activities or imminent threat of hostilities or civil strife, acts of war or insurrection, fire, quarantines, Acts of God, delays, irregularity, theft, itinerary or schedule changes or cancellations, or for acts or omissions or default of any company or person engaged in conveying the passengers or carrying out the arrangements of these tours, or for personal dissatisfaction with itinerary or accommodations provided, or for any consequential or incidental damages, whatsoever. The passage contract in use by the airlines, and other carriers, when the ticket is issued, shall constitute the sole contract between the airlines or carriers and the purchaser of these tours or passengers. The carriers, hotels, tour guides, and other suppliers providing tour services are independent contractors, and not agents, employees, or servants of, or joint-venturers with, Newport International Travel or its affiliates. The tour operator cannot accept the responsibility for loss or additional expense due to delay, or changes in schedules, or other causes. No responsibility is accepted for loss of, or damage to, baggage or any of the passenger's belongings. Baggage insurance is recommended. If the services included in the tour cannot be supplied or there are changes in an itinerary, the tour operator will arrange for the provision of comparable services. Any resulting additional expense will be payable by tour participants and any resulting saving will be refunded by the tour operator to tour participants, with due provision for the tour operator's profit. Newport International Travel reserves the right to decline or to retain any person as a participant of any tour. Tour operator or guide are not obligated to delay the tour to wait for, or search for, any tour participants who separate from the tour group or who fail to show up at designated meeting places and times; such persons need to catch up with the tour group at their own expense and liability. Newport International Travel shall not be responsible for any purchases made by tour members during or outside of the tour, whether or not recommended by the tour guide (who is an independent contractor). The issuance or acceptance of booking, ticket, invoice, receipt, or voucher, or the payment of a deposit or tour charges, shall be deemed to be consent to the above conditions, as well as to notices and disclaimers provided on our invoices, itineraries, ticket jackets, vouchers, tour schedules, and announcements to tour members.

BAGGAGE: Free transatlantic airline checked baggage allowance, subject to change without notice, at the time of this printing is two bags per person; but, please check with the respective airline for limits on dimensions and weights, as well as the number, of bags allowed on your flights. Excess baggage will be charged at established rates. There are stricter baggage restrictions on flights within Turkey and between European airports. We urge tour participants to carry only one bag per person, if possible, for convenience while traveling by bus.

SMOKING: Smoking may not be allowed on buses or other carriers, with the exception of the driver in certain cases.

RESOLUTION OF DISPUTES: No person, other than an authorized officer of Newport International Travel, by a document in writing, is authorized to vary, to add to, or to waive any term or condition presented herewith. These terms and conditions are subject to change by the tour operator without notice. Any controversy or claim arising from, or relating to, a tour purchased from Newport International Travel shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association; the arbitration proceedings shall be conducted in Irvine, California, U.S.A.

REGARDING THE CALIFORNIA SELLER OF TRAVEL LAW

THE "CALIFORNIA SELLER OF TRAVEL LAW" REQUIRES ALL WHO SELL AIR OR SEA TRAVEL IN THIS STATE, EITHER SEPARATELY OR IN CONJUNCTION WITH OTHER TRAVEL SERVICES, TO DISCLOSE CERTAIN INFORMATION:

Upon cancellation of the transportation or travel services where the customer is not at fault and has not canceled in violation of any previously disclosed terms and conditions of the transportation or travel services, all sums paid to this travel company for services not received by the customer will be promptly refunded to the customer, in accordance with the agreed-to terms and conditions, unless the customer otherwise advises us in writing. This does not apply where this company has remitted the payment to a carrier, without obtaining a refund.

California law requires certain sellers of travel to have a trust account or bond. This business has a trust account for those transactions that are applicable.

FOR PURCHASERS OF TRANSPORTATION OR TRAVEL SERVICES WHO ARE LOCATED IN CALIFORNIA AT THE TIME OF THE SALE:

This business is a participant in the Travel Consumer Restitution Fund (TCRF). You, the passenger, may request reimbursement from TCRF if you are owed a refund of more than $50 for transportation or travel services which was not refunded in a timely manner by a seller of travel who was registered and participating in the TCRF at the time of sale. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRC within 6 months (in some circumstances 1 year) after the scheduled completion date of the travel. A claim must include sufficient information and documentation to prove your claim, and a $35 processing fee. You must agree to waive your right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a claim with the TCRF, if you were located in California at the time of the sale.

FOR CUSTOMERS WHO WERE NOT PHYSICALLY LOCATED IN CALIFORNIA AT THE TIME OF THE SALE:

Your transactions are not covered by the California Travel Consumer Restitution Fund.

FOR PURCHASERS OF AIR, SEA, OR LAND TRANSPORTATION OR TRAVEL SERVICES FURNISHED BY ENTITIES LOCATED OUTSIDE OF THE UNITED STATES:

You hereby acknowledge receipt of this disclosure cautioning you that the provider of the transportation or travel services is not in compliance with the Seller of Travel Law and the transaction is not covered by the Travel Consumer Restitution Fund, and that you are aware of the attendant risks and consequences thereof.
